2 Year Consumer Limited Warranty
Upright products are warranted to be free from defects in materials and workmanship under normal use for 2 year from the date of purchase by the original purchaser (“Warranty Period“).
Upright Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
If during the Warranty Period any component part of the product becomes defective by reason of defects in material or workmanship, the Company will either, at its discretion, refund the purchase price of the product, replace or repair the defective product. SUCH REMEDY SHALL BE YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY BREACH OF WARRANTY.
EXCEPT FOR THE ABOVEMENTIONED LIMITED WARRANTY, THE PRODUCT IS PROVIDED ON AN “AS IS” BASIS AND THE COMPANY DISCLAIMS ANY AND ALL OTHER WARRANTIES OF ANY NATURE WHATSOEVER WITH RESPECT TO THE PRODUCT, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED, PARTICULARLY INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
This warranty granted herein does not apply to: (i) cosmetic damage, such as scratches, nicks and dents; (ii) consumable parts, such as batteries and adhesive tape unless product damage has occurred due to a defect in materials and workmanship; (iii) damage caused by accident, abuse, misuse, water, flood, fire, or other acts of nature or external causes; (iv) damage caused by service performed by any third parties which are not authorized distributors and/or authorized service provider of the Company; (v) damage to a product that has been modified or altered without the written permission of the Company; (vi) damage to a product due to combination of the product with equipment or software not authorized by the Company; or (vii) any product which had its serial number or any other identification markings removed, modified or rendered illegible.
TO THE EXTENT PERMITTED BY LAW, THE WARRANTIES AND REMEDIES CONTAINED HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY LIABILITY ARISING UNDER ANY WARRANTY OF MERCHANTABILITY FOR A PARTICULAR PURPOSE, STATUTORY OR OTHERWISE. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, WHICH MAY VARY BASED ON YOUR JURISDICTION.
TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL UPRIGHT BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, WHETHER RESULTING FROM THE USE, MISUSE, OR INABILITY TO USE THIS PRODUCT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
THE PRODUCT IS PROVIDED FOR PERSONAL USE ONLY AND DOES NOT PROVIDE OR CONSTITUTE PROFESSIONAL, MEDICAL OR PARAMEDICAL ADVICE OR HEALTHCARE SERVICES AND MUST NOT BE RELIED UPON AS SUCH. YOU SHOULD MAKE ALL MEDICAL OR HEALTH RELATED DECISIONS ON THE BASIS OF PROFESSIONAL ADVICE FROM A LICENSED PHYSICIAN OR QUALIFIED HEALTH CARE PROFESSIONAL WHO IS FULLY AWARE OF YOUR INDIVIDUAL CIRCUMSTANCES.
